Dispute Over Military Family Support Group Domain Name
A support group for the families of Illinois military personnel has been granted permission to continue using its Domain Name, operationhomefront.org, despite a dispute opened against the group by an international, California-based support group of the same name, which owns operationhomefront.net.
The World Intellectual Property organisation dismissed the dispute, because Mr Quinn, the registrant of operationhomefront.org, had been running an organisation of that name since 1991. Ms Leyva, a military spouse who founded the national organisation, argued that Mr Quinn’s website served to confuse and mislead the public who often ended up at his website when they were looking for hers.
Lawyers for Ms Leyva’s group claimed that Mr Quinn registered his domains in 2001, at around the same time that Ms Leyva began her group, "in an attempt to divert donors and additional publicity” from the natural group. They also claimed that he made this attempt in order to further his own political ideals.
Mr Quinn has said that the phrase "operation home front" is probably in use by many support groups for the families of the military and for service members, and that the term is generic. He also added that he had hoped that his group and Ms Leyva’s would be able to band together rather than bicker, as they both backed the same excellent cause.
