Businessman Stephen Cleeve Loses Battle for stephencleeve.com
Stephen Cleeve, frequently accused of fraudulent business activity by consumer protection groups, has failed to secure the ownership rights to stephencleeve.com. The domain name is currently being used for a website which claims to provide information about Cleeve's business schemes.
In order for the domain name to be transferred to Stephen Cleeve's control, he is required to prove that the Domain Name in dispute is identical or confusingly similar to a trademark or service mark held by the person; that the owner of the address has no rights or legitimate interests in the domain, and that it was registered and is being used in bad faith.
While the World Intellectual Property Organisation (WIPO) has agreed that the name "Stephen Cleeve" is a trademark held by the businessman, Cleeve has failed to prove that the consumer rights group currently using the domain name has no legitimate claim to its use.
Cleeve argues that the website owners' claims about him and his business practices are libellous and defamatory, but this dispute is outside of WIPO's jurisdiction. It is likely that Cleeve intends to take the dispute to court.
